C.4645 10.1 ORDINARY COUNCIL MEETING HELD 21 DECEMBER 2022 That the minutes of the Ordinary Council meeting held on Wednesday, 21 December 2022 be confirmed as a true and correct record of that meeting.
C.4646 13.1.1 WA Local Government Association (WALGA) Licence Agreement – Portion of 2 Grey Street, Northam (Northam Visitor Centre) That Council in accordance with Policy A 8.5 Management of Council Property Leases, section 3.0 Subsidised Community Not-For-Profit, approve a licence agreement for the WA Local Government Association to utilise office space at 2 Grey Street, Northam (Northam Visitor Centre) for a period of five (5) years with a five (5) year renewal option and a monthly licence fee of $500 inclusive of GST and outgoings.
C.4647 13.2.1 Project deferral/budget amendment That Council:
1. Defer Grass Valley South Road, $280,000 SLK 0.00 – 1.10 to the 2023/24 financial year and incorporate in the 2023/24 draft budget.
2. Authorise an unbudgeted expenditure from Job 3125 (Grass Valley South Road SLK 0.00 – 1.10) to allocate to  the following capital works:
a. Lyon St SLK 0.00 – 0.60 $8,383
b. Markey St SLK 0.00 - 0.11 $8,942
c. Southern Brook Road SLK 16.33 – 17.30 $197,000
3. Reduce DRFAWA AGN 962 revenue by $71,633.
4. Authorise the remaining $5,958 to be absorbed within the current budget.
C.4648 13.3.1 Urgent Works – Old Quarry Road Liquid Waste Facility That Council resolve to:
1. Adopt the proposed amendments to the liquid waste disposal fees and charges effective from 1 March 2023 as follows:

Local $0.10 per litre $0.08 per litre
Regional $0.12 per litre $0.08 per litre
Metro $0.14 per litre $0.08 per litre
Advertise the proposed amendments to the public pursuant to section 6.19 of the Local Government Act 1995.
2. Approve the unbudgeted expenditure of $110,000 from the Septage Ponds reserve in accordance with the provisions of section 6.8 of the Local Government Act 1995 to carry out emergency works at the Old Quarry Road Liquid Waste Facility.
C.4649 13.3.2 South West Native Title Settlement – Land Base Consultation That Council, regarding the transfer of land under the South West Native Title Land Settlement:
1. Advises the Department of Planning, Lands and Heritage that the Shire of Northam is not supportive of the transfer of the identified land to the Noongar people.
C.4650 13.4.1 Accounts & Statements of Accounts – 1 December 2022 to 31 December 2022 That Council receive the payments for the period 1st December 2022 to 31st December 2022, as listed:

• Municipal Fund payment cheque numbers 35543 to 35549 Total $59,627.70.
• Municipal Fund EFT45753 to EFT46052 Total $2,127,298.89.
• Direct Debits Total $105,047.33.
• Payroll Total $519,667.53

TOTAL: $2,811,641.45

Which have been made in accordance with the delegated authority reference number (M/F/F/Regs LGA 1995 S5.42).
C.4651 13.4.2 Financial Statement for the periods ending 31 December 2022 That Council receives the Financial Statements, prepared in accordance with the Local Government (Financial Management) Regulations, for the period ending 31 December 2022.
C.4652 14 MATTERS BEHIND CLOSED DOORS That Council, in accordance with section 11.1(i) of the Shire of Northam Standing Orders Local Law 2018 and Section 5.23 (2) (A) or (C) of the Local Government Act 1995, meet behind closed doors to consider agenda items:

• 14.1 – STAFF RESOURCES as the item relates to  a matter affecting an employee.
• 14.2 – WELLINGTON / DUKE STREET LAND (FORMER VICOTRIA OVAL SITE) as the item relates to a contract that may be entered in to.
C.4653 14.1 STAFF RESOURCES That Council approve the addition of 1 Full Time Equivalent (FTE) in the Corporate Services area in accordance with phase 1 of the future projected staffing requirements outlined in the Shire of Northam Integrated Workforce Plan.
C.4654 14.2 WELLINGTON / DUKE STREET LAND (FORMER VICTORIA OVAL SITE) That Council;
1. Advises Uniting Church Homes that it will not exercise the option contained within Clause 11.3 of Contract for Sale of Land for 135-155 Wellington Street East, between the Shire of Northam (seller) and Uniting Church Homes trading as Juniper (buyer), for the repurchase of the subject property.
2. Authorises the Chief Executive Officer to continue to explore potential future purchasers of 135-155 Wellington Street East .
