C.5355 13.1.1 Council Plan (Corporate Business Plan Component) Review & Workforce Strategy That Council, by ABSOLUTE MAJORITY, ADOPTS the revised Corporate Business components of the Council Plan 2025/26 as presented in Attachment 13.1.1.1, subject to the following amendment:

- Item 7.3.3 being reflected as needing additional external funding for 2025/26 and 2026/27.
C.5356 13.1.1 Council Plan (Corporate Business Plan Component) Review & Workforce Strategy That Council ADOPTS the Shire of Northam Workforce Strategy 2025/26 to 2028/29 as presented in Attachments 13.1.1.2 and 13.1.1.3.
C.5357 13.1.2 Western Australian Local Government Association (WALGA) - Annual General Meeting That Council:

1. NOMINATES the Shire President and Deputy Shire President as voting delegates at the 2025 Western Australian Local Government Association Annual General Meeting; and
2. NOMINATES Cr J E G Williams as a proxy voting delegate at the 2025 Western Australian Local Government Association Annual General Meeting.
C.5358 13.1.3 Change of Council Meeting Date - September & October 2025 That Council:
1. APPROVES the change of date for the Council Forum Meeting from 17 September 2025 to 10 September 2025.
2. APPROVES the change of date for the Ordinary Council Meeting from 24 September 2025 to 17 September 2025.
3. APPROVES the change of date for the Council Forum Meeting from 15 October 2025 to 8 October 2025.
4. APPROVES the change of date for the Ordinary Council Meeting from 22 October 2025 to 15 October 2025.
5. REQUESTS the Chief Executive Officer to publish the change of meeting dates on the Shire of Northam website in accordance with Regulation 12 of the Local Government (Administration) Regulations 1996 and on the Shire’s social media platforms.
C.5359 13.1.4 Delegated Authority Register 2025/26 - Amendment That Council, BY ABSOLUTE MAJORITY, ENDORSES the amended Delegated Authority Register 2025/26 as provided in Attachment 13.1.4.1.
C.5360 13.3.1 CP.50 Trading on Thoroughfares and Public Places Policy Trial review That Council ADOPTS CP.50 Trading on Thoroughfares and Public Places Policy presented in Attachment 13.3.1.1.
C.5361 13.4.1 Rates Exemption Application - 260 Fitzgerald St, 53 & 55 Wellington St, 49 Old York Rd, Northam That Council does NOT SUPPORT a rate exemption for land used exclusively for charitable purposes for Avon Community Employment Support Centre Inc. trading as Essential Personnel for the below properties:

1. 260 Fitzgerald St, Northam (A14364)
2. 53 Wellington St, Northam (A12511)
3. 55 Wellington St, Northam (A12512)
4. 49 Old York Road, Northam (A15384).

C.5363 13.4.3 Budget Adoption 2025/26 That Council, by ABSOLUTE MAJORITY, for the 2025/26 financial year:

1. ADOPTS the following annual fees for payment of Council Members in lieu of individual meeting attendance fees, pursuant to section 5.99 of the Local Government Act 1995, and within the range determined by the Salaries and Allowances Tribunal:
a. President $23,600
b. Councillors $19,750 

2. ADOPTS the following annual Information & Communication Technology (ICT) expenses allowance for Council Members, pursuant to section 5.99A of the Local Government Act 1995 and within the range determined by the Salaries and Allowances Tribunal:
a. ICT Expenses Allowance $3,500

3. ADOPTS, pursuant to section 5.98(5) of the Local Government Act 1995 and within the range determined by the Salaries and Allowances Tribunal, the following annual local government allowance to be paid in addition to the annual meeting allowance:
a. President $45,000

4. ADOPTS, pursuant to section 5.98A of the Local Government Act 1995 and within the range determined by the Salaries and Allowances Tribunal, the following annual local government allowance to be paid in addition to the annual meeting allowance:

C.5364 13.4.3 Budget Adoption 2025/26 That Council, by ABSOLUTE MAJORITY, ADOPTS the following Rubbish and Recycling Fees for the 2025/26 financial year:

a)    Residential and Commercial waste charge                          $   216.00
b)    Residential and Commercial recycling charge                     $   111.00
c)    Pensioner residential recycling charge                                 $     90.00

C.5365 13.4.3 Budget Adoption 2025/26 That Council, by ABSOLUTE MAJORITY, for the 2025/26 financial year:

1. IMPOSES, pursuant to sections 6.32, 6.33, 6.34 and 6.35 of the Local Government Act 1995, the following differential general and minimum rates on Gross Rental and Unimproved Values for the 2025/26 financial year for the purpose of yielding the deficiency disclosed by the Municipal Fund Budget in recommendation 6:

a. Differential General Rates
i. Residential (GRV) 11.3500 cents in the dollar
ii.Commercial / Industrial (GRV) 12.1850 cents in the dollar
iii. Agriculture Local (UV) 0.4350 cents in the dollar
iv. Agriculture Regional (UV) 0.4000 cents in the dollar
v. Rural Small Holdings (UV) 0.7250 cents in the dollar

b. Minimum Rates
i. Residential (GRV) $1,159.00
ii. Commercial / Industrial (GRV) $1,159.00
iii. Agriculture Local (UV) $$1,159.00
iv. Agriculture Regional (UV) $1,114.00
v. Rural Small Holdings (UV) $1,159.00
 

2. OFFERS, pursuant to section 6.45 of the Local Government Act 1995 and regulation 64(2) of the Local Government (Financial Management) Regulations 1996, a one, two and four instalment payment option, and sets the following due dates for the payment in full by instalments:
a. Full payment & 1st instalment due date 11 September 2025
b. 2nd half instalment due date 14 January 2026
c. 2nd quarterly instalment due date 12 November 2025
d. 3rd quarterly instalment due date 14 January 2026
e. 4th & final quarterly instalment due date 18 March 2026. 

3. ADOPTS, pursuant to section 6.45 of the Local Government Act 1995 and regulation 67 of the Local Government (Financial Management) Regulations 1996, an instalment administration charge where the owner has elected to pay rates (and charges) through an instalment option of $10.00 for each instalment after the initial instalment is paid.

4. ADOPTS, pursuant to section 6.45 of the Local Government Act 1995 and regulation 68 of the Local Government (Financial Management) Regulations 1996, an interest rate of 5.5% where the owner has elected to pay rates and charges through an instalment option.

5. ADOPTS, pursuant to section 6.51(1) and subject to section 6.51(4) of the Local Government Act 1995 and regulation 70 of the Local Government (Financial Management) Regulations 1996, an interest rate of 11% for rates (and charges) and costs of proceedings to recover such charges that remain unpaid after becoming due and payable on 11 September 2025.

6. WAIVES, for eligible pensioners and seniors, the instalment interest, instalment administration charge and penalty interest.
C.5366 13.4.3 Budget Adoption 2025/26 That Council, by ABSOLUTE MAJORITY, ADOPTS the amended Schedule of Fees and Charges for 2025/26 financial year as contained in Attachment 13.4.3.3.
C.5367 13.4.3 Budget Adoption 2025/26 That Council, by ABSOLUTE MAJORITY, in accordance with regulation 34(5) of the Local Government (Financial Management) Regulations 1996, and AASB 1031 Materiality, APPROVES that the level to be used in statements of financial activity in 2025/26 for reporting material variances shall be a percentage of 10 or a minimum of $20,000, whichever is greater.
C.5368 13.4.3 Budget Adoption 2025/26 That Council, by ABSOLUTE MAJORITY, pursuant to the provisions of section 6.2 of the Local Government Act 1995 and Part 3 of the Local Government (Financial Management) Regulations 1996, ADOPTS the Municipal Fund Budget as contained in Attachment 13.4.3.1 for the Shire of Northam for the 2025/26 financial year.
C.5369 13.4.4 Accounts & Statement of Accounts - June 2025 That Council RECEIVES the payments for the period 1 June to 30 June 2025, as listed below:

•                   Municipal Fund payment cheque numbers 49 to 54 = $25,098.01
•                   Municipal Fund EFT54455 to EFT544755 = $1,801,977.48
•                   Direct Debits = $102,415.88
•                   Superannuation = $96,966.14
•                   Payroll = $538,470.57

TOTAL: $2,564,928.08

C.5370 13.4.5 Financial Statements for the period ending 30 June 2025 That Council RECEIVES the Financial Statements, prepared in accordance with the Local Government (Financial Management) Regulations, for the period ending 30 June 2025.
C.5371 14 Motion to move behind closed doors That Council, in accordance with section 11.1(i) of the Shire of Northam Standing Orders Local Law 2018 and Section 5.23 (2)(A) & (B) of the Local Government Act 1995, meet behind closed doors to consider agenda items:

- 14.1 - Application under CP. 29 Rates Hardship, as this relates to the personal affairs of any person.
- 14.2 - Chief Executive Officer Review & Selection Committee Meeting held 01 July 2025, as this relates to a matter affecting an employee or employees.
- 14.3 - Chief Executive Officer Review & Selection Committee Meeting held 16 July 2025, as this relates to a matter affecting an employee or employees.
C.5372 14.1 Application under CP.29 Rates Hardship That Council:

1. APPROVES the payment arrangement of $50.00 per fortnight for the current owner of A566 until 30 June 2026.
 
2. APPROVES the payment arrangement of $50.00 per month for the current owner of A15804 until 30 June 2026.
C.5373 14.2 Chief Executive Officer Review & Selection Committee Meeting held 01 July 2025 That Council RECEIVES the minutes from the Chief Executive Officer Review & Selection Committee meeting held on 1 July 2025.
C.5374 14.2 Chief Executive Officer Review & Selection Committee Meeting held 01 July 2025 That Council:
1. ACCEPTS the Chief Executive Officer Key Performance Indicator Progress Report from 22 March to 21 June 2025, as presented in Attachment 6.1.1 of the Committee minutes.

2. ADOPTS the Chief Executive Officer Key Performance Indicators, as developed in conjunction with Hammond Woodhouse Advisory, for the period 1 July 2025 to 30 June 2026, as outlined in Attachment 6.2.1 of the Committee minutes.
C.5375 14.2 Chief Executive Officer Review & Selection Committee Meeting held 01 July 2025 That Council, BY ABSOLUTE MAJORITY, ENDORSES the review of the Chief Executive Officer’s performance for 2024/25 and NOTES that the Chief Executive Officer has achieved the Key Performance Indicators.

C.5377 14.3 Chief Executive Officer Review & Selection Committee Meeting held 16 July 2025 That Council APPROVES an increase of the Chief Executive Officer’s Total Remuneration Package (TRP) of 3.5%, bringing the TRP for 2025/26 to $328,519 per annum effective from 1 July 2025.
